By accessing or using this website (the “Site”), you agree to comply with and be bound by the following Terms and Conditions. 1. DEFINITIONS & ACCEPTANCE

By visiting our Site or engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

2. WEBSITE USAGE

2.1 Eligibility
You must be at least 18 years of age (or the age of majority in your jurisdiction) to use this Site or engage our services.

2.2 Prohibited Uses
You agree not to use the Site or its content for any illegal or unauthorized purpose. You may not use the Site to violate any laws in your jurisdiction (including but not limited to copyright laws).

2.3 Intellectual Property
All content on this Site, including text, graphics, logos, icons, images, and software, is the property of BW Tree Removal or its content suppliers and is protected by applicable intellectual property laws. Any unauthorized use of the materials on this Site may violate copyright, trademark, and other laws.

2.4 Modifications to the Site
We reserve the right to modify, suspend, or discontinue the Site (or any part thereof) at any time, with or without notice.

3. SERVICE TERMS

The terms in Sections 3 through 13 apply to any tree removal, tree trimming, stump grinding, debris removal, and related services (“Services”) provided by BW Tree Removal.

3.1 Service Provider & Client

  • Service Provider: BW Site Prep, DBA BW Tree Removal
  • Client: Any individual or entity entering into a service agreement with BW Tree Removal for the scope of work described in a written estimate or contract.

4. PAYMENT TERMS

  • Payment Due: Payment in full is due upon completion of the described work for all residential clients. Commercial clients may be accommodated based on their established payment terms (e.g., Net 30, Net 60).
  • No additional work will be performed without prior written consent from both parties. Any change in cost or timeline must be agreed upon in writing.

5. RESPONSIBILITIES OF THE PARTIES

5.1 Service Provider Obligations

  • Perform all work in a professional, timely, and workmanlike manner.
  • Make reasonable efforts to minimize damage to the Client’s property.
  • Remove debris related to the specified scope of work from the site (excluding items noted as not included).

5.2 Client Obligations

  • Provide access to the property during scheduled work times.
  • Notify BW Tree Removal in writing of any underground lines, septic systems, irrigation systems, or other buried objects prior to commencement of work.
  • Obtain any necessary permissions or permits from neighbors or local authorities, if required.

6. PROPERTY CONDITIONS & LIMITATIONS

  • Grass and Landscape: The Client acknowledges that while BW Tree Removal will make reasonable efforts to prevent damage, heavy machinery can cause ruts or damage to grass, soil, or landscaping. BW Tree Removal shall not be held liable for such damage. Grass saver mats are available upon request for an additional fee. Please notify BW Tree Removal for any questions and accommodations concerning your grass and landscape and we will be happy to assist you.
  • Preexisting Conditions: BW Tree Removal is not liable for any preexisting property damage or conditions, including but not limited to existing fence damage, compromised structures, or decay.
  • Undisclosed Hazards: BW Tree Removal shall not be responsible for damage to any underground lines, septic systems, or other buried objects not disclosed in writing before the start of work. If unsure, please call 811 to identify any underground hazards or notify BW Tree Removal if you need assistance with this process.

7. INSURANCE & LIABILITY

  • BW Tree Removal carries liability insurance as required by law and can provide proof upon request at any time.
  • The Client agrees to indemnify and hold harmless BW Tree Removal from any claims arising due to undisclosed hazards or conditions on the property.

8. WEATHER & UNFORESEEN DELAYS

In the event of inclement weather or other unforeseen circumstances (such as equipment failure or safety hazards) that pose a risk to personnel or property or significantly disrupt the work schedule, BW Tree Removal reserves the right to postpone or reschedule the services until conditions are deemed safe and feasible. BW Tree Removal will communicate any schedule changes to the Client as soon as practicable. BW Tree Removal shall not be liable for any damages or delays caused by events beyond its reasonable control.

9. UNFORESEEN EQUIPMENT REQUIREMENTS

Client acknowledges that all pricing and work plans provided by BW Tree Removal are based on information available and conditions reasonably observable at the time of contracting. In the event that BW Tree Removal determines during the course of its work that additional or alternative equipment (such as cranes or specialized machinery) is required due to circumstances not apparent at the time of estimation (including, but not limited to, unexpected tree conditions, site constraints, or safety hazards), BW Tree Removal reserves the right to suspend work and issue a revised proposal. The revised proposal may include modified pricing, scheduling, and scope of services to address the newly discovered requirements. Should the Client choose not to accept the revised proposal, BW Tree Removal may terminate this Agreement without any further liability beyond refunding any unused portion of the Client’s deposit or prepayment, and neither party shall have any additional obligations to the other.

10. MECHANICS LIEN

If payment is more than 90 days past due, BW Tree Removal reserves the right to file and enforce a mechanic’s lien (or similar lien) on the property, as permitted by South Carolina law. The Client will be responsible for any reasonable attorney’s fees, filing fees, and other costs incurred in the process of filing or enforcing the lien.

11. DISPUTE RESOLUTION

  • In the event of a dispute arising under this Agreement, both parties agree to first attempt to resolve the issue through good-faith negotiations or mediation.
  • If mediation fails, the dispute shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association or a similar governing body.
  • Both parties agree to waive any rights to pursue legal action in a court of law, except where arbitration does not resolve the dispute.

12. TERMINATION

  • Either party may terminate this Agreement if the other party materially breaches any term herein.
  • The Client shall be responsible for payment for all work completed up to the date of termination.

13. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the State of South Carolina, without regard to its conflict of laws principles.

14. ENTIRE AGREEMENT

This Agreement, including any addenda or exhibits, constitutes the entire understanding between BW Tree Removal and the Client regarding the services described herein. It supersedes all prior discussions, negotiations, or agreements, whether oral or written.

15. SEVERABILITY

If any provision of this Agreement is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16. CHANGES TO TERMS AND CONDITIONS

BW Tree Removal reserves the right to modify these Terms and Conditions at any time. Any changes will be posted on this page with an updated “Last Updated” date. Your continued use of the Site or engagement of our services after any modifications indicates acceptance of those changes.
